1. Binding Agreement
By accessing Floromance's website (https://floromance.com ("Site") or using our services ("Services"), you agree to these legally binding Terms. Continuing to use, means you accept the terms and conditions posted on the website.
2. Eligibility
To submit an order for products or services through our website, you must be 18 years or older and have a valid credit or debit card with full authority to use it. If you do not agree with any of these Terms and Conditions, please do not use the floromance.com website.
3. Account Security
You are responsible for:
a) Maintaining account credential confidentiality;
b) Promptly updating registration information;
c) All activities conducted under your account.
Floromance reserves the right to suspend accounts containing incomplete or unverifiable information.
4. Orders and Pricing
4.1 All floral products are handcrafted; actual items may vary from website images.
4.2 We reserve the right to:
a) Correct pricing (including discounts);
b) Refuse service for suspected fraudulent activity.
5. Payment Terms
5.1 Accepted methods: Visa, Mastercard, American Express, PayPal, Shopify Payment.
5.2 Some orders may incur customs/duties (buyer's responsibility).
6. Shipping and Risk Transfer
6.1 Title and risk of loss transfer to the buyer upon carrier acceptance.
6.2 Delivery dates are estimates; Floromance bears no liability for carrier delays.
6.3 Signature-required deliveries become your responsibility after the first attempted delivery.
7. Returns & Refunds
7.1 Perishable floral arrangements are FINAL SALE.
7.2 Contact service@floromance.com within 24 hours with photographic evidence for damaged/missing items. Approved claims receive replacement credit only.
8. Intellectual Property
You agree that you own or license the copyright (or are authorized by the copyright owner to send to us and use) any content or images you submit to us for custom work, and you warrant that none of the content or images contain anything that would infringe on any copyright, trademark, design right or other intellectual property right of any third party. We will not check the content of any images provided by you. However, if we believe any image does not comply with these terms, we reserve the right to refuse to use it, without any obligation or liability to you. We will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity of or locate anyone sending any material in breach of these terms.
9. Prohibited Conduct
You agree not to:
a) Reverse engineer or exploit Site vulnerabilities;
b) Employ automated data scraping tools;
c) Infringe third-party rights through Services;
d) Transmit malware or unsolicited communications.
10. Disclaimer of Warranties
SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS LIMIT WARRANTY EXCLUSIONS; CONSULT LOCAL REGULATIONS.
11. Limitation of Liability
In No Event Shall Floromance's Aggregate Liability Exceed The Purchase Price Paid. We Disclaim Liability For:
(a) Consequential Or Punitive Damages.
(b) Third-Party Products/Services.
(c) Force Majeure Events Or Carrier Failures.
12. Indemnification
You agree to indemnify, defend and hold harmless Floromance and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
13. General Provisions
13.1 Assignment: Floromance may transfer rights hereunder; you may not assign without written consent;
13.2 Severability: Invalid provisions shall not affect remaining Terms;
13.3 Force Majeure: Not liable for delays beyond reasonable control;
13.4 Survivability: Sections 6-13 shall survive termination.
14. Data Collection & Tracking Technologies
14.1 Cookie Consent
a) First-time users must explicitly consent to non-essential tracking through our preference center (GDPR Art. 7 compliance)
b) Essential cookies for site functionality are automatically enabled
14.2 Data Categories Collected
